Blue Cross and Blue Shield of North Carolina responds to suit by Huntersville doctor - Charlotte Business Journal:

The N.C. insurer and its codefendants deny claimsby Dr. John Powderlg II in a $20 million lawsuit. Powderlyt claims the insurers kept him out their network to avoid payingfor high-cost treatment for cancetr patients. Also named as defendantx are Blue Crossand , the and Health Care Servicexs is the parent for several Blue Cross organizations. The while differing in some details, are The insurers contend they have committexd noantitrust violations. And they deny Powderly's contentio that as the dominant insurerx intheir regions, the groups exercise monopoly power over health-carr payments. The N.C.
organization says Powderly is trying to force Blue Crossa to deal with hispractice -- -- on his terms rathet than the insurer's. Blue Cross of North Carolina says Powderly'x group administers Phase I clinical trials and thos trials involve initial testing forunapproved drugs. Blue Crosss says it is not required to provide coverage forthoses trials. It does, the insuref says, provide coverage for later-phas clinical trials involvingapproved drugs. Blue Crosx says it denied Powderly "in-networi status" solely because of those Phase I It denies there is any conspiracy or othed motive behindthe decisions.
All the insurers also contend the case woulxd be more appropriately heared in a Florida federak court that is close to approvinbg a negotiated settlementof class-action antitrust accusationes against Blue Cross organizations. The groupsx attempted to transfer Powderly's case to that courg and asked U.S. District Court Judge Frank Whitney to stay actionws in the case pendingthat transfer.
